3. Copyright Infringement Claims

We take copyright infringement seriously and comply with applicable laws, such as the Digital Millennium Copyright Act (DMCA). If you believe that content on ProshnoUttor violates your copyright, you may submit a takedown notice to us. Similarly, if your content is removed due to a copyright claim, you may file a counter-notice.

How to Submit a Copyright Infringement Notice

To report infringing material, please send a written notice to our designated Copyright Agent with the following information:

  1. A physical or electronic signature of the copyright owner or their authorized representative.
  2. Identification of the copyrighted work you claim has been infringed (e.g., a URL or description of the work).
  3. Identification of the material on ProshnoUttor that you believe is infringing, including its location (e.g., a specific URL or screenshot).
  4. Your contact information (name, address, phone number, and email).
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, their agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Our Response

Upon receiving a valid notice, we will:

  • Remove or disable access to the allegedly infringing content.
  • Notify the user who posted the content, providing them an opportunity to respond with a counter-notice.

4. Counter-Notice Process

If you believe your content was removed in error or misidentification, you may submit a counter-notice to our Copyright Agent with:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its prior location on ProshnoUttor.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed due to a mistake or misidentification.
  4. Your name, address, phone number, and a statement consenting to the jurisdiction of the courts in Delaware, USA, and accepting service of process from the claimant.

Send your counter-notice to the same contact details listed above. If the counter-notice is valid and no legal action is taken by the claimant within 10-14 business days, we may restore the content at our discretion.

5. Repeat Infringers

We reserve the right to terminate the accounts of users who are repeat infringers of copyright, as determined by multiple valid infringement notices or other evidence of habitual violation.

6. Limitations

  • We are not responsible for determining the validity of copyright claims beyond complying with legal requirements.
  • Submitting false or misleading notices or counter-notices may result in legal liability, including damages and attorney fees.
